The session will include insights from the Appleby team that acted on the recent Sian Participation case where the U.K.'s Privy Council considered the interaction between insolvency proceedings and arbitration where a winding up petition is founded on a debt which is subject to an arbitration agreement. That case declared the previous leading English authority, Salford Estates, wrongly decided and has important consequences for many offshore jurisdictions.
