‘Remove references to Carduus Group & publish retraction’, demands Brian Gilmour

Sir,

It has been brought to our attention that Carduus have been mentioned along with a long list of other companies in a blog written by yourself on a website entitled www.offshorealert.com.

In addition to putting yourself in a libellous situation, some the information with regards to our company is factually incorrect. For example Mr Stuart Black is no longer a director of any Carduus company and as a consequence we would not expect Carduus to be mentioned in any context in this blog.

As a blogger taking worldwide subscriptions you will be aware of the laws of libel in the UK with reference to the internet and social media and we have passed details of your blog to our lawyers DWF along with our international legal team Berwin Leighton Paisner. To avoid any unnecessary legal dialogue we will accept the removal of any reference to our company within this or any future blogs penned by you and/or your site along with a retraction apologising for any inference within this particular piece.

    Firstly, I'm not a "blogger" and the content you referred to is an article not a "blog". I'm a professional journalist, trained and qualified by the National Council for the Training of Journalists, in the United Kingdom.

    Your claim that I have 'put myself in a libellous situation' is ridiculous and betrays a chronic lack of understanding of international libel laws. It also indicates that you did little or no research on me and OffshoreAlert prior to sending such a letter.

    Regarding Mr. Black and his involvement with the Carduus Group, we reported that he had resigned from Carduus Finance Limited and Carduus Limited and that he was still a director of Carduus (St. Vincent) Ltd., information that we obtained recently from Companies House. Following receipt of your letter, I checked Companies House records again and saw that, on June 16th, 2015 (i.e. just 15 days ago), Carduus (St. Vincent) Ltd. notified Companies House that Mr. Black had resigned as a director of the firm, a filing that wouldn't have entered the public domain until the next day. I have amended our story to reflect this very recent change. However, it is a moot point. The information reported was not libelous and it is absurd to claim that it is. I also note that Mr. Black is still identified as the registrant for the domain name 'carduus.com'.

    I further note that you are a member of Black Gilmour McGartland LLP, which placed a false valuation on land in Scotland for an investment fraud conducted via Advalorem Value Asset Fund Ltd., of Gibraltar.

    References to Carduus will not be removed from our story and your request for a "retraction" has been treated with the contempt it deserves. Given Mr. Black's involvement and your involvement with Black Gilmour McGartland, I intend to investigate Carduus Group and any other companies you are involved with for red flags.
