Statute of Limitations – Beware the Snake in the Grass

There's a common misconception that all statute of limitation periods are equal. This misconception can prove not just costly, but fatal where creditors, claimants, or those representing them seek to recover allegedly fraudulently transferred funds. This session will examine this issue from the perspective of a litigant seeking to attack the transfer of funds to a trust set up in 'trust-friendly' jurisdictions, in particular the Cook Islands, The Bahamas, Cyprus and Nevis. Other important procedural issues such as the applicable standard of proof, statutorily imposed litigation secrecy provisions, and the impact of 'flee-clauses' will also be examined. Speakers
