This session will examine the dos and don'ts for insolvency office-holders.
Given the number of large scale, multi-creditor and trans-national insolvencies in recent years, it's not surprising that insolvency office-holders have increasingly found themselves under the lens, whether that be of the supervising court or indeed of the creditor committee.
A number of recent court decisions in the common law world have highlighted the duties required and standards expected of insolvency office-holders. These decisions make clear the need for heightened scrutiny and due diligence in the exercise of those office-holders' functions and how the courts will approach applications to fix remuneration.
These decisions and other developments in this area will be examined in detail during this session.
